THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10567 of 2016 ORDER:

The petitioner who is the sole accused in Crime No.14 of 2016 of K.D.Peta Police Station, Visakhapatnam District, filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in the above crime for the offences punishable under Sections 20(1)(b) and 25 of NDPS Act. Though various grounds are raised, learned counsel for the petitioner restricted his prayer seeking release for a limited period on the ground that the marriage of the son of the petitioner is scheduled to be performed on 12.08.2016 at Annavaram and his presence is very much necessary. It is true that the presence of the petitioner is very much necessary at the time of marriage of his son, but, the same needs to be verified. Hence, the trial Court shall verify as to the fact of marriage and then pass appropriate orders for release of the petitioner on bail for a limited period in accordance with law.
