This Civil Miscellaneous Second Appeal is filed against Order, dated 28-02-2015, in IA.No.142 of 2015 in MA.No.87 of 2015, on the file of the Court of the learned Chief Judge, City Small Causes Court, Hyderabad.
The appellant filed the above-mentioned appeal against notice, dated 12-02-2015, issued by respondent Nos.1 and 2 demanding arrears of Rs.12,11,132/- payable in respect of the premises, in occupation of the appellant as a tenant, towards property tax. In the IA filed by the appellant in the said appeal, the lower Court has passed a conditional interim order granting stay of the demand impugned in the appeal subject to the appellant depositing a sum of Rs.2,80,943/- on or before 20.03.2015.
At the hearing, Mr.R.N.Reddy, learned Counsel for the appellant, submitted that as his client has some difficulty in depositing the entire amount in one lumpsum, it has filed IA(Sr) No.1549 of 2015 seeking permission for payment of the amount directed to be deposited by the lower Court in installments and that the said application is pending. Inasmuch as the lower Court has exercised its discretion by passing the conditional interim order, I do not find any reason to interfere with the same. However, the lower Court is directed to dispose of IA(Sr).No.1549 of 2015 within one week from the date of the receipt of this order.
At this stage, the learned Counsel for the appellant submitted that the lower Court has extended the time for payment of the amount of Rs.2,80,943/- till 13-04-2015.
As the appellant's application for permission to pay the said amount in installments is directed to be disposed of by the lower Court, the time extended by the lower Court shall stand extended till disposal of the aforesaid IA (Sr). Subject to the above directions, this Civil Miscellaneous Second Appeal is disposed of.
