THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.2121 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The action of the respondent in issuing E-auction notice da 08.01.2015, and thereby bringing the subject flat to sale, is questioned in Writ Petition.
Smt. V. Padmaja Reddy, Learned Counsel for the petitioner, has pla before this Court an affidavit filed by the petitioner undertaking to repay outstanding loan amount within three months i.e., by the end of April, 2015. Sri B. Hanumantha Rao, Learned Counsel for the respondent bank instructions, would state that, in the light of the undertaking now given by petitioner, the respondent bank would not confirm the sale till 30.04.2015. Recording the undertaking given by the petitioner that the entire l amount would be repaid by the end of April, 2015, the respondent ban directed not to confirm the sale till then. The Writ Petition is, accordin disposed of. It is made clear that, in case the petitioner does not deposit entire amount due by then, it is open to the respondent to proceed and con the sale in accordance with law. No costs.
