HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.30987 of 2016 ORDER:

The present writ petition is filed challenging the rejection of the petitioners applications dated 19-12-2014 for conversion of agricultural land into non-agricultural land to an extent of Ac.0-42 cents in Sy.76/1B, Ac.1-85 cents in Sy.No.76/2B, Ac.3-64 cents in Sy.No.79/1 of the 1st petitioner and an extent of Ac.4-44 cents of agricultural land situated in Sy.No.79/2 of the 2nd petitioner. The petitioners were issued pattadar passbook and title deeds and their names are recorded in ROR Form-1B as pattadars of the respective extents.

Learned counsel for the petitioners says that without issuing notice to the petitioners and without recording any reasons, their applications have been rejected, which is in violation of principles of natural justice.

Learned Assistant Government Pleader for Revenue produced written instructions from the 2nd respondent stating that since the subject lands are recorded as Sarkar Annadeena Punja (AWD) lands and basing on the recommendations of the 3rd respondent, the applications have been rejected.

A reading of the impugned order goes to show that no notice was issued to the petitioners and no reasons are recorded in the said order. As the order is bereft of reasons,

the impugned order is set aside. The 2nd respondent is directed to issue notice to the petitioners and after hearing them, pass orders in accordance with law.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
