This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking bail in Crime No.3/2016-17 on the file of the Prohibition and Excise Police Station, Rajahmundry, registered for the offence under Sections 8(c) read with Section 20(b)(i) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioner herein is that the petitioner along with the other accused was found in illegal possession of 120 kgs., of ganja.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and that he has been falsely implicated in the present case. He prays this Court to grant bail to the petitioner. Considering the fact that the quantity of ganja, which was found in possession of petitioner/A.1 and other accused, is commercial quantity and also as there is a bar to grant bail in case of commercial quantity, this Court is not inclined to grant bail to the petitioner/A.1.
