This writ petition is filed challenging the action of the respondents in seizing and keeping the Tractor bearing registration No.TS 04-EE-4848 along with Plough, without following the procedure.

The petitioner is the owner of Tractor bearing registration No.TS 04-EE-4848 along with Plough. When the same was seized on 28.09.2015 by the respondents 2 and 3, the present writ petition is filed. Now the learned Government Pleader, on the basis of the instructions, submits that the POR.No.46/84 was booked against the petitioner. In the above circumstances, the respondents 2 and 3 are directed to produce the aforesaid vehicle before the competent Court, and liberty is given to the petitioner to file appropriate application for release of vehicle. If the offence is compoundable, it is open to the respondents 2 and 3 to release the vehicle by passing an order of compounding the offence. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
