ORDER

The petitioners preferred the present criminal revision case challenging the order dated 23.04.2015 passed in Crl.M.P.No.2328 of 2014 in C.C.No.9 of 2004 on the file of Metropolitan Sessions Judge, Hyderabad.

2. The petitioners/accused filed Crl.M.P.No.2328 of 2014 seeking to return the documents pertaining to movable and immovable properties concerned with the main case. By the order impugned, the trial Court dismissed the said application due to non-prosecution. Hence, the present revision is filed.

3. Heard both sides and perused the material on record.

4. Since the application filed by the petitioners was dismissed for non-prosecution, it is always open to them to file a fresh application before the trial Court. Therefore this Court is not inclined to interfere with the order impugned. However, the petitioner is at liberty to file a fresh application before the trial Court and on filing such an application, the trial Court shall consider and dispose of the same on merits.

5. The Criminal Revision Case is, accordingly, disposed of. Miscellaneous Petitions, if any, pending in this revision shall stand closed.
