HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16751 OF 2016 ORDER:
The case of the petitioner is that earlier she filed writ petition in W.P.No.12133 of 2014 for restoration of the bore well in Sy.No.369 seized by the respondent authorities and the said writ petition was disposed of directing the 3rd respondent to restore the subject bore well and also directed not to interfere with the usage of the said bore well for drawing the water by the petitioner with a liberty to the respondents 1 to 3 to follow due process of law if they intend to take any action against the petitioner. Accordingly, the respondents issued show cause notice dated 23.04.2016 asking the petitioner to show cause as to why action should not be taken under the provisions of AP WALT Act-2002 for illegal sale and transportation of ground water and why the bore well in Sy.No.369 should not be seized.
In pursuance to the same, the petitioner submitted explanation on 27.04.2016. Aggrieved by the action of the respondents in seizing the bore well, without considering the explanation submitted by the petitioner in pursuance to the notice dated 23.04.2016, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue produced copy of the order dated 10.05.2016 passed by the respondent authorities in pursuant to the above notice, which goes to show that petitioner's explanation was examined. Heard the learned counsel for the unofficial respondents. Since the grievance of the petitioner that his explanation is not considered is redressed in view of the order dated 10.05.2016 passed by the respondent authorities, the cause in the writ petition does not survive.
Accordingly, the writ petition is closed with liberty to the petitioner to challenge the proceedings dated 10.05.2016 and the respondent authorities shall serve a copy of the order dated 10.05.2016 to the petitioner forthwith. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
