HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2530 OF 2014 ORDER:
The present Criminal Revision Case is filed under Section 397 r/w. 401 of Cr.P.C., by the petitioner/A.2, aggrieved by the docket order dated 07.11.2014 passed in Crl.M.P.No.3539 of 2013 in Crime No.157 of 2012 by the III Additional Judicial Magistrate of First Class, Kothagudem, Khammam District, wherein the Court below, after perusing the sworn statements and the material on record, took cognizance of the case against the petitioner/A.2 for the offences punishable under Sections 323, 427, 447, 452 and 395 r/w. 149 of IPC. Challenging the said order, the present revision came to be filed.
As there was no representation on behalf of the petitioner on 19.12.2014, the matter was directed to be listed after one week. On 29.12.2014, at the request of the learned counsel for petitioner, it was directed to be listed after Sankranthi Vacation, 2015. From that day onwards, the matter never listed.
Learned counsel for the petitioner submits that PRC.No.25 of 2014 is now committed to the Court of Sessions and the charges are not framed till date. The learned counsel would further submit that there is no material to connect the petitioner with the above crime. If
really the petitioner is innocent of the offence alleged and if the allegations made against him do not attract any of the offences alleged and as the charges are not framed till date, it is always open for the petitioner to make an application for discharge before the appropriate Court, in which event, the same shall be dealt with in accordance with law.
Subject to the above direction, the Criminal Revision Case is disposed of.
