THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.13742, 14338 & 14758 of 2003 COMMON ORDER:

Since the issue raised in these writ petitions is one and the same, the writ petitions are heard together and disposed of by this common order.

For the sake of convenience, the facts in W.P.No.14338 of 2003 are discussed hereunder.

The petitioner is challenging the orders passed by the Assistant Commissioner of Labour/2nd respondent in M.W.Case No.39/2002 dated 02.06.2003 wherein the 2nd respondent had directed the petitioner to pay the difference of wages amounting to Rs.23,762/- under Minimum Wages Act, 1948.

This Court was pleased to grant interim stay on condition of the petitioner depositing Rs.10,000/- vide order dated 17.07.2003.

Now, the issue is with regard to payment of Rs.13762/-. As the petitioner could not point out any grave irregularity and illegality in the orders passed by the 2nd respondents under the Act, this Court cannot interfere with the orders passed by the 2nd respondent. Ends of justice would be met, if the petitioner is directed to pay the balance amount as directed by the disciplinary authority.

There are no merits in the writ petitions and accordingly they are dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
