This second appeal is filed by the judgment debtor, under Section 100 of C.P.C., assailing the decree and judgment dated 22.11.2016 in A.S. No.51 of 2013 on the file of the Court of the IX Additional District Judge, West Godavari at Kovvur, wherein and whereby the order of dismissal dated 02.09.2013 passed in E.A.No.256 of 2012 in E.P.No.208 of 2009 in O.S.No.595 of 2005 on the file of the Court of the I Additional Junior Civil Judge, Kovvur was confirmed.

S.A.M.P.No.2673 of 2017 is filed by the petitionerappellant to permit him to compromise the matter with the respondent-decree holder in terms of compromise. 3.
Petitioner and second respondent are present.
The second respondent is representing the first respondent. Sri Mangena Sree Rama Rao, learned counsel for the petitioner, identified the petitioner in the open Court. Mr.M.Koteswara Rao, learned counsel, representing Sri N.Subba Rao, learned counsel for the respondents, identified the second respondent in the open Court. The first respondent filed affidavit to permit the second respondent to represent her in order to enter into compromise on her behalf.

Heard the learned counsel for both the parties and perused the record. This Court read over and explained conditions of the Memorandum of Compromise to the petitioner and the second respondent in Telugu and they admitted the same. The petitioner and the second respondent on his behalf and on behalf of the first respondent, in the open Court, submitted that they entered into compromise to put an end to the litigation at the advice of the elders. 5.
Accordingly, S.A.M.P.No.2673 of 2017 is allowed. Consequently, the Second Appeal is disposed of, in terms of the compromise. Miscellaneous petitions, if any, pending in this Second Appeal shall stand closed.
