THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.1524 of 2024 O R D E R:
This Criminal Petition is filed by the petitioner - A2 under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C.") for grant of regular bail in Crime No.18 of 2024 of PS Bodhan Town, Nizamabad District, registered for the offence under Section 20(b)(ii) of Narcotic Drugs and Psychotropic Substances Act (for short "NDPS Act"), 1985. 2.
The case of the prosecution in brief was that on 09.01.2024 at 09:00 AM, the Sub-Inspector of Police (for short "SI"), Bodhan Town lodged a report stating that on credible information that a person was selling ganja in Aneesanagar locality, the SI proceeded to the said place along with his staff and found A1 selling some packets, apprehended him and seized 2 kgs of dry ganja from his possession.

Basing on the said report, the above crime was registered and during the course of investigation, on confession of A1, the Police searched the house of A2 and seized 50 grams of dry ganja from the house of A2. 4.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submitted that the petitioner was an old aged woman of 65 years and a small quantity of dry ganja of 50 grams was recovered from her house, she was taken into custody on 09.01.2024 and since then she was in jail and prayed to enlarge the petitioner - A2 on bail. 6.
Learned Additional Public Prosecutor opposed grant of bail to the petitioner.

Considering that only a small quantity of 50 grams of dry ganja was recovered from the possession of the petitioner and considering that the petitioner was an old aged woman of 65 years, it is considered fit to grant bail to the petitioner.

In the result, the Criminal Petition is allowed directing the petitioner - A2 to be released on bail on her executing a personal bond for Rs.10,000/- with two sureties for the like sum each to the satisfaction of the Judicial First Class Magistrate, Bodhan and the petitioner - A2 shall comply with all the conditions stipulated under Section 437(3) of Cr.P.C.
As a sequel, miscellaneous applications pending in this petition, if any shall stand closed.
