The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri V RAMCHANDER GOUD, Advocate for the Petitioner, Addl. PUBLIC PROSECUTOR (TG) for the Respondent, the Court made the following.

THH HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1094 of 2020 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/accused, seeking to grant anticipatory bail to him in Crime No.45 of 2020 on the file of Chandanagar Police Station, Cyberabad District, registered for the offences under Sections 420, 471 IPC and under Section 156(3) Cr.P.C.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent-State and perused the record.

lt is alleged in the complaint that there was a development agreement dated 01 .12.2008 between the de-facto complainant and the accused to complete construction of residential flats within 18 months in the land of the de-facto complainant, but the accused failed to do the same and demanding huge amounts from her, thereby cheated her with dishonest intention for unlaMul gain. 4.
Learned counsel for the petitioner/accused submits that there is no development agreement registered in favour of the petitioner by the de-facto complainant, but there was a registered sale deed executed by her in his favour in the year 2008 before the SubRegistrar's Office, Serilingampally and after a lapse of 12 years, she filed a false complaint against him without there being any iota of evidence. He further submits that the de-facto complainant filed a L-.-i-
private complaint against the petitioner falsely in order to meet her illegal demands and that the case is purely civil in nature. He further submits that the petitioner ts ready to cooperate with the investigation and he shall abide by any condition imposed by this Co u rt.

Learned Additional Public Prosecutor opposed to grant anticipatory bail to the petitioner/accused and submits that the case is still under investigation.

ln view of the nature of allegations leveled against the petitioner/accused and other facts and circumstances and in view of the fact that the registered sale deed was executed in favour of petitioner by the de-facto complainant, without adverting to the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/accused, by imposing some conditions. 7.
Accordingly, the Criminal Petition is allowed and the petitioner/accused is directed to surrender before the Station House Officer, Chandranagar Police Station, Cyberabad District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail on his executing a personal bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to his satisfaction. Further, the petitioner/accused shall abide by the conditions stipulated in Section 438(2) Cr"P.C and co-operate with the investigating officer in investigating the case. e--

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
