THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION No. 6194 of 2017 ORDER: (Per VRS,J) Aggrieved by the dismissal of a stay petition pending disposal of a regular appeal arising out of the revision of assessment, the dealer under the Telangana Value Added Tax Act has come up with the present writ petition.

Heard Mr. P. Vasudeva Reddy, learned counsel for the petitioner.

Mr. T. Vinod Kumar, learned special standing counsel for Commercial Taxes (Telangana), takes notice for the respondents. 4.

The petitioner has already paid 25% of the disputed tax after the admission of the regular appeal. Therefore, the rejection of the stay petition in total, may not be proper. Hence, the Writ Petition is disposed of, granting an interim stay in favour of the petitioner, pending disposal of the regular appeal, subject to the condition that apart from the 25% of the disputed tax, which the petitioner has already paid, the petitioner shall pay another 25% of the disputed tax, within a period of four (4) weeks from the date of receipt of a copy of this order.
