THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5258 of 2001 ORDER :

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not regularising the services of the petitioner as Sales Assistant, as arbitrary and illegal and sought for a consequential direction to the respondents to regularise the services of the petitioner as Sales Assistant in the regular pay scale.

Heard Sri J.Seshagiri Rao, learned counsel for the petitioner and the learned standing counsel for the respondents. 3.

It has been contended by the petitioner that she has been appointed as Sales Assistant in the Andhra Pradesh State Handloom Weavers Co-operative Society Ltd., on 01.10.1989 and she is fully eligible and qualified to be regularised in terms of G.O.Ms.No.212, Finance and Planning (FW.P.C.III) Department, dated 22.04.1994, but the respondents are not considering her case.

The learned counsel appearing for the petitioner has contended that the persons, who are similarly situated with that of the petitioner, who are working with the respondents, had filed W.P.No.13966 of 1999 & batch and a Division Bench of this Court vide common orders dated 31.12.2002 was pleased to dispose of the writ petitions directing the respondents to consider the case of the petitioners therein for regularisation in accordance with the rules. Therefore, the learned counsel contends that the issue raised in this

writ petition is squarely covered by the above said writ petition and similar directions may be given to the respondents. 5.

This Court having considered the said submissions, is of the considered view that this writ petition can be disposed of in terms of the common orders passed by a Division Bench of this Court in W.P.No.13966 of 1999 & batch, dated 31.12.2002 directing the respondents to consider the case of the petitioner for regularisation, if she is working as on today, in accordance with the rules and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
