HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A.No.147 OF 2018 JUDGMENT: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present appeal, the appellant has challenged the order dated 23.01.2018 passed in I.A No.01 of 2018 in W.P.No.1410 of 2018 by the learned Single Judge of this Court.
2. Learned counsel appearing on behalf of the appellant submits that as per the UGC proceedings dated 07.09.2007, National Eligibility Test (NET) conducted by UGC, CSIR and ICAR are mutually recognised, therefore the appellant is entitled to apply for the post of Assistant professor in Agricultural Economics. Therefore, the learned Single Judge should have considered that when the similar notification prescribing similar educational qualifications issued by Dr. Y.S.R. Horticulture University for the same post of Assistant Professor in Agricultural Economics, the appellant application was considered, and he was issued call letter to appear for the interview. Therefore the learned Single judge should have directed the 1st respondent to permit the appellant to appear for the interview for the post of Assistant Professor in Prof. Jayashankar Telangana State Agricultural University.
3. We note, as per page No.56 of the present appeal, the appellant is Post Graduate in Agricultural Economics
SKK,J & AKS,J WA No.147 of 2018 from Dr Yeshwant Singh Parmar University of Horticulture and Forestry. The said certificate is issued on 01.12.2014. Moreover, the 1st respondent has certified that the appellant has acted as instructor for the course entitled "Fundamentals of Agricultural Economics { AECO -141 (2+0) }" at the Agricultural College, Warangal for the period from 20.10.2016 to 15.03.2017.
4. In addition to above, as per the eligibility for the post of Assistant Professor in question the UGC also issued certificate which is at page No.55 which establishes that the appellant has qualified NET in Economics.
5. Learned counsel appearing on behalf of the respondents submits that the eligibility criteria is that the candidate has qualified NET in Agricultural Economics, whereas, the appellant herein has qualified NET in the subject of Economics not in Agricultural Economics.
6. Since the appellant is Post Graduate in Agricultural Economics, therefore he appeared for NET, and certificate of NET is awarded in the subject of Economics.
7. Since the writ petition filed by the appellant is pending for adjudication and the present appeal against the interim order, therefore, we hereby deem it appropriate, without recording our opinion on merit, the 1st respondent shall allow the appellant to participate in the interview, his
SKK,J & AKS,J WA No.147 of 2018 result shall be kept in a sealed cover and that will be subject to outcome of the writ petition pending before the learned Single Judge of this Court.
8. In view of the above, this Writ Appeal is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any pending, shall stand closed.
