THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3273 of 2019 O R D E R:
Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos. 2 and 3 Learned counsel for the petitioner fairly concedes that the petitioner has no objection for removing such portion of the construction which is beyond the compound wall. She however submits that the construction which is made within the compound wall is the property of the petitioner and notice is required to be issued by the respondent authorities with regard to the same before any action is taken.
In view of the submission of the learned counsel for the petitioner that the petitioner would remove that portion of the construction encroaching on to the footpath, she shall do so within a period of two weeks from the date of receipt of a copy of this order. Even after such removal, if the respondent authorities find that any other construction is objectionable, they shall issue notice to the petitioner to remove such portion and after considering the explanation that may be submitted by her, pass orders in accordance with law.
Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:19.02.2019 kdl
