THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO I.A.Nos.3 & 4 OF 2019 IN/AND CRIMINAL PETITION No.960 OF 2019 COMMON ORDER:

The petitioner/accused and the 2nd respondent-de facto complainant are present along with their respective counsels. I.A.Nos.3 & 4 of 2019 are filed by them to compound the offences against the accused in S.C.No.2 of 2019, on the file of learned IX Additional District & Sessions Judge, Warangal, which is outcome of Crime No.108 of 2016 of Kazipet Police Station, Warangal District, registered for the offences punishable under Sections 376, 365, 342, 324 & 506 IPC by stating that since de facto complainant and accused both are Advocates and saying due to the differences, they resorted to this and amicably settled through elders and accused prepared to pay to the de facto complainant any compensation, she is not willing, but for in directing to pay to Army Welfare Fund and subject to payment of Rs.50,000/- to the Army Welfare Fund by obtaining DD and terms of the compromise was also appended. DD bearing No.238046, dated 19.02.2019, is filed.

In view of the compromise between the parties, I.A.Nos.3 & 4 of 2019 are allowed by compounding the offences. Consequently, the Criminal Petition is allowed and the proceedings against the petitioner/accused in S.C.No.2 of 2019, on the file of learned IX Additional District & Sessions Judge, Warangal, are hereby quashed, petitioner/accused is acquitted and the bail bonds of accused, if any, stands cancelled. Registry is directed to send the DD to the Army Welfare Fund.

Dr. SSRB,J Crl.P.No.960 of 2019 Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
