THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.CMP No.141 of 2015 ORDER:

This petition is filed under Section 24 of C.P.C to withdraw O.P.No.877 of 2014 from the file of the Family Court, Vijayawada and transfer the same to the Family Court at Kakinada.

2. When the matter is taken up for hearing, learned counsel for petitioner has sought permission of the Court to permit the petitioner to withdraw the Transfer CMP. He also requested to dispense with the presence of the petitioner/wife in O.P.No.877 of 2014 on each and every date of adjournment. Permission to withdraw the Transfer CMP is accorded and the presence of the petitioner is also dispensed with. However, the petitioner shall appear before the Family Court, Vijayawada, as and when her presence is so required in O.P.No.877 of 2014.

3. Accordingly, the Transfer CMP is dismissed as withdrawn. No costs. Miscellaneous petitions, if any pending, in this petition shall stand closed.
