HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7419 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.426 of 2014 of Kachiguda Police Station, Hyderabad registered for the offense punishable under Sections 417 and 420 I.P.C.

2) Heard the learned counsel for the petitioner and the 1st respondent-State represented by the Public Prosecutor before admission, before ordering notice to the 2nd respondent and perused the material on record. 3) perusal of the report of the defactocomplainant/2nd respondent, no doubt prima facie no doubt makes out a case undisputedly for investigation and hence there are no grounds for quashing of F.I.R but for the petitioner entitles concession of bail as within the so called amounts borrowed, if any other than Rs.8,00,000/-.

4) Having regard to the same, the application is disposed of, giving liberty to the petitioner to surrender before the learned Magistrate and move for regular bail with notice to the A.P.P concerned and in such an event, the learned Magistrate shall hear and grant bail with necessary conditions on the same day. Needless to say the learned Magistrate can dispense with the presence of the petitioner

post bail stage. Further remedies, if any, to the petitioner after filing final report and after taking cognizance by the learned Magistrate, are left open.

5) With the above observations, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
