THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.1518 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.9 in Crime No.859 of 2024 before the S.R. Nagar Police Station, Hyderabad.

The brief facts of the case are on 13.09.2024, a complaint was received from Patthi Gopal, stating that he and his family of seven were attacked at Taza Kitchen, SR Nagar, Hyderabad, on 12.09.2024, around 22:30 hours. While waiting for their food, someone tried to take it, leading to a confrontation. The person called around 10 others, who attacked Gopal's family, including his wife, daughter, son, and son-in-law. The ladies were cornered and attacked, and despite their pleas, the attackers threw dustbins and utensils at them. The watchmen from Taza Kitchen intervened, but the attackers used abusive language. The individuals involved were identified as Laxmi Narayana, Manish, Vinay, Banu

Prakash, Shiva Shakti, and others from Pochamma Basti, Panjagutta.

Heard Sri Gurram Sridhar, learned counsel appearing on behalf of the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the alleged offences do not meet the necessary ingredients as alleged. He further submitted that the allegations are vague and lack specific details, and the petitioner is innocent and falsely implicated. As a juvenile and college student, the petitioner asserts their good character and willingness to cooperate with the police. Therefore, prayed this Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioner, stating that the allegations leveled against the petitioner are serious in nature. At this stage,

granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

Having regard to the rival submissions made and on going through the material placed on record, it appears that the petitioner is juvenile. Considering that the petitioner is a student and the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to compliance of the following conditions: i.

The petitioner shall surrender before the Station House Officer, S.R. Nagar Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
