HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16803 of 2005 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondent to restore the increments which were deferred without cumulative effect after completion of punishment period with all consequential benefits including pay fixation and arrears of pay. 2.

Heard Sri P. Govindarajulu, learned counsel for the petitioner, and Sri B. Mayur Reddy, learned standing counsel for the respondent. 3.

It has been submitted by the petitioner that the respondent had imposed a punishment of deferment of annual grade increment without cumulative effect on him vide proceedings dated 21.01.2003. Subsequently, the respondent also imposed similar punishments vide proceedings dated 22.01.2004 and 16.07.2004.

The grievance of the petitioner is that after the currency of punishments, he is entitled for increments, but the respondent has not released the increments, and to this effect, though he submitted a representation to the respondent on 16.03.2005, no orders have been passed thereon so far.

Learned standing counsel for the respondent has not disputed the pendency of representation of the petitioner dated 16.03.2005.

Having considered the submissions made by the parties and perused the record, this Court is of the view that the writ petition can be disposed of directing the respondent to consider the representation of the petitioner.

Accordingly, the writ petition is disposed of directing the respondent to consider the representation of the petitioner dated 16.03.2005 and pass appropriate orders thereon, within a period of four (4) weeks from the date of receipt of a copy of this order. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
