HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.496 OF 2013 ORDER:
Having regard to the nature of prayer and also with the passage of time, learned counsel for the petitioner requests the Court to permit the petitioner not to press writ prayer, but give liberty to petitioner to represent to 1st and 2nd respondents for refund of excess deposit, if any made by the petitioner, and they may be directed to consider and dispose of the representation. The alternative prayer of learned counsel though is not made in the writ petition, this Court is of the view that it can be considered and the following order can be passed.
The petitioner is given liberty to make representation to respondents 1 and 2 on his grievance of collection of surplus deposit amount or any other grievance and if such a representation is made, the 1st and 2nd respondents are directed to consider and pass appropriate order as is warranted in the circumstances of the case. The petitioner is also given liberty to communicate copy of this order along with his representation.
The writ petition is disposed of accordingly. No order as to costs.
