HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 6702 of 2004 O R D E R:- Dr.P.B.Vijay Kumar, learned counsel for the petitioner, submits that the order of dismissal of the petitioner from service has been modified, in pursuance of which, the petitioner has been reinstated into service, however the period when the petitioner was out of employment was treated as dies non. Challenging the same, the petitioner has filed W.P.No. 1092 of 2015 which is pending adjudication, as such, the cause in the present writ petition does not survive and the matter has become infructuous.
In view the above submission, the writ petition is dismissed as infructuous. If the petitioner has any grievance in respect of the period, which has been treated as dies non, and his reinstatement with minimum time scale of pay, the same will be the subject matter of W.P.No. 1092 of 2015. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
