THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1499 of 2015 ORDER:

Heard learned counsel for petitioner and perused the impugned Order dated 5.12.2014 in Crl.M.P.No.2334 of 2014 in C.C.No.186 of 2014 on the file of XIV Special Magistrate, Hyderabad. Having regard to the submission of learned counsel for petitioner that it is important for the petitioner to summon and examine the son of Dhanraj i.e., C.D. Karthikeyan, as a witness to establish his defence and therefore, he may be ordered to be summoned as defence witness if not as Court witness, this Criminal Petition is allowed and the impugned Order dated 05.12.2014 in Crl.M.P.No.2334 of 2014 in C.C.No.186 of 2014 is set aside and the learned XIV Special Magistrate, Hyderabad, is directed to summon Mr. C.D.Karthikeyan as a witness on behalf of defence for examination. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
