THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.5311 of 2016 ORDER:
The request of petitioner/ plaintiff seeking leave of the Court to receive documents in I.A.No.311 of 2016 is rejected through the order impugned in the revision. The suit is one for specific performance of agreement of sale dated 23-10-2006. The petitioner now seeks the leave of the Court to file various documents brought into existence pendente lite. This Court is of the view that the purchasers pendente lite are already parties in the suit. They have also filed written statements. Firstly, I do not see any reason to interfere with the reasoning given by the trial court and secondly, it is always open to the plaintiff to pray for working out comprehensive decree as and when the petitioner/ plaintiff is in a position to make out that a case for specific performance is made out.
The Civil Revision Petition fails and accordingly dismissed. However, with the observations indicated above. No order as to costs.
