This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A5, in Crime No.32 of 2017 on the file of the Station House Officer, Chinturu Station, East Godavari District. The offences alleged are under Sections 8(c) r/ w 20(b)(ii) & (c) of NDPS Act.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The Public Prosecutor brings to the notice of this court the earlier petition viz., Crl.P.No.3698 of 2017, filed by this petitioner and A5 seeking bail, was dismissed by this court by virtue of the order dated 07.06.2017.

A perusal of the said order shows that considering the merits of the case, the petition filed by the petitioners therein, who are A4 and A5, was dismissed. Hence, this petition is not maintainable.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Sessions court. The Sessions Court shall dispose of the bail application, if any filed, on merits, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
