HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE NO.196 OF 2020 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.) seeking to set aside the order dated 04.02.2020 passed in Crl.MP.No.114 of 2020 in C.C.No.1109 of 2015 on the file of the II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Cyberabad at Malkajgiri. Crl.MP.No.114 of 2020 is filed under Section 70(2) Cr.P.C. to recall the non-bailable warrant (NBW) issued against the petitioner/A-1.

The docket order dated 04.02.2020 in Crl.MP.No.114 of 2020 reads as under.

"Accused No.1 absent. Hence Petition is Dismissed." Having regard to the facts and circumstances of the case and to meet the interests of justice, the order dated 04.02.2020 passed in Crl.MP.No.114 of 2020 in C.C.No.1109 of 2015 is set aside and the petitioner/A-1 is directed to surrender before the Court concerned within ten days. On such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the said Court. It is further directed that the petitioner shall personally appear before the Court concerned on each and every date of adjournment till conclusion of the trial. It is made clear that if the petitioner fails to comply with the condition imposed, the liberty granted to the petitioner/A-1 shall automatically stand

cancelled and the trial Court would be at liberty to take steps in accordance with law to secure his presence.

Subject to the above, the Criminal Revision Case is disposed of. Miscellaneous applications, if any, pending shall stand closed. _________________ (G. SRI DEVI, J) 10th March 2020 RRB
