THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.3304 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue a writ, order or direction particularly in the nature of Writ of Mandamus directing the respondents 3 and 4 to consider the representation of the petitioner dated 18.12.2017 and conduct the enquiry as directed by the District Collector in his Lr.No.D5/457/2018 dated 2-2-2018 and conclude the same by initiating the appropriate action by declaring the action of the respondents 3 and 4 in not considering the said representation of the petitioner and initiating appropriate action as illegal and arbitrary and pass such other order or orders as this Hon'ble Court may deem fit and proper.'
Perusal of the record reflects that when the petitioner approached the District Collector, Ranga Reddy District, letter dated 02.02.2018 was addressed by the said Collector to the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, calling upon him to enquire into the contents of the application dated 18.12.2017 made by the petitioner and to take necessary action under intimation to the Collector's office. The complaint of the petitioner presently is that no action has been taken by the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, pursuant to the aforestated communication.
It is not open to the Tahsildar to remain unmoved by a direction of his superior and at that, no less than the Administrative Head of the District.
The writ petition is accordingly disposed of directing the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, to complete the enquiry as
directed by the District Collector, Ranga Reddy District, and take necessary action upon the petitioner's application dated 18.12.2017 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
