RESPONDENTS Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order, writ or direction more in the nature of a mandamus a. By declaring the action of the respondents in not considering the claim of the petitioner for selection and appointment to the post of Civil Assistant Surgeon pursuant to proceedings No.Rc.No.82O1lE6.Cl2O17, Date.OS-12-2O17 bearing Notification No.01i20'17 without giving weightage to the services rendered by the petitioner in the erstwhile state of Andhra Pradesh by putting condition at para 13A c as illegal, arbitrary, unjust, discriminatory and violative of Articles 14,19 and 21 of the Constitution of lndia apart from being contrary to the provisions of A.P.

Reorganization Act, 2014 more particularly Section 77 of the act for a consequential direction to the respondents to consider the claim of the petitioner for selection and appointments to the post of Civil Assistant Surgeon by extending the weightage for the service rendered by him with all consequential benefits.

When the matter is taken up for hearing, Mr. Sri Krishna, learned counsel representing Mr. A. P. Venugopal, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with a liberty to file fresh writ petition by making necessary amendments 2.

Permission is accorded.

Reserving such liberty, the writ petition is dismissed as withdrawn. No costs.

Miscellaneous petitions, if any, pending in this writ petition, shall also stand dismissed.
