Heard learned counsel for the petitioner/accused of C.C.No.121 of 2015 on the file of Additional Judicial Magistrate of First Class, Jagtial, where the learned Magistrate has taken cognizance for the offences punishable under section 304A IPC and section 38 r/w 192 MV Act and also heard the learned public prosecutor, representing the 1st respondent - State.

The petitioner is given liberty to file application under Section 251 Cr.P.C., as held by the Hon'ble Apex Court in Bhushan Kumar Vs. State (NCT of Delhi)1, as entire material is available with the trial court to consider on own merits.

Accordingly and with the above observation, this criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
