THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2740 OF 2018 ORDER:

Challenging the action of the third respondent and the officials of the second respondent in interfering with the possession and enjoyment of the petitioner over the land bearing survey No.1 admeasuring Acs.5.22 guntas situated in Muthvalliguda Village, Kachiwanisingaram Gram Panchayat, Ghatkesar Mandal, Ranga Reddy District.

The learned Government Pleader, on the basis of written instructions, submits that the land situated in Survey No.1 is a private patta land and not the Government land. Neither the second respondent nor the third respondent interfered with the possession of the petitioner. He further submits that one Smt U.Vani, fourth respondent, submitted a representation to the District Collector on 11.12.2017 and on the instructions of the District Collector, the third respondent visited the land and noticed that some developmental activities are being undertaken on the ground. On enquiries, the workers informed that the land belongs to the petitioner. The complainant, fourth respondent, is also present on the ground and stated that there is an order of status quo in I.A.No.841 of 2016 in O.S.No.733 of 2016, dated 28.02.2017. In view of the same, the third respondent requested both the parties not to undertake any activity in obedience of the orders of the Court. Except advising the parties, the third respondent never interfered with the possession of the petitioner.

In view of the above instructions by the learned Government Pleader, no further orders are necessary in the writ petition. It is

open to the parties to work out their remedies in the pending civil suit.

The writ petition is accordingly closed. Consequently, miscellaneous petitions pending, if any, in the writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 01.02.2018 pln
