THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2738 of 2018 ORDER:

It is the case of the petitioners that they have applied for providing financial assistance notified under S.C. Corporation Plan, 2017, and that the second petitioner had initially applied for loan for establishment of photo studio and video unit and DCCB, Illandu branch, had also given consent letter for Rs.1,00,000/-. However, as there was no communication from the fourth respondent Corporation, the same could not be made use of by the petitioners. Thereafter, the second petitioner taking into consideration the changed circumstances had applied for financial assistance for Car Taxi with a cost of Rs.8,00,000/- during 2017-18. In spite of the fact that the petitioners have fulfilled all the conditions, the fourth respondent Corporation has failed to act on their applications. Thus, the petitioners are deprived of their livelihood and unable to utilize the scheme notified by the Government.

Learned Standing Counsel appearing for the fourth respondent submits that the petitioners' applications are pending consideration on account of paucity of funds and that as and

CKR, J W.P.No.2738 of 2018 when the funds are received, the same would be processed on priority basis as number of other applications are pending. In those circumstances, the Writ Petition is disposed of with the direction to respondents 3 and 4 to process the applications of the petitioners and consider granting financial assistance in terms of the scheme subject to the petitioners fulfilling the conditions laid down under the scheme and the Rules of the Bank and subject to availability of funds, as expeditiously as possible.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
