THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.2863 of 2015 ORDER:
This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/A.2 in C.C.No.12 of 2015 on the file of the I Additional Judicial First Class Magistrate, Nizamabad.
The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to her under law including filing of the discharge petition, if charges are already not framed.
Permission is granted.
Learned counsel for the petitioner submitted that the presence of the petitioner may be dispensed with before the trial Court on each and every date of adjournment. There is no dispute with regard to the identity of the petitioner. Even if the presence of the petitioner is dispensed with, no prejudice will be caused to the second respondent.
Hence, the Criminal Petition is dismissed as withdrawn. The presence of the petitioner, who is accused No.2 in C.C.No.12 of 2015 on the file of the I Additional Judicial First Class Magistrate, Nizamabad, is hereby dispensed with on each and every date of adjournment. However, she shall appear before the trial Court as and when her presence is so required.
Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
