SMT JUSTICE T.RAJANI CRIMINAL PETITION No.983 OF 2018 ORDER:

This Criminal Petition is filed for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.116 of 2017 on the file of the Station House Officer, Women Police Station, Charminar, South Zone, Hyderabad. The offences alleged are under Sections 498A, 406, 506 IPC and Section 4 & 6 of D.P. Act. 2.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

The counsel for the petition8er submits that the complaint was filed by the de facto complainant, making allegations of demand of dowry and harassment only after the petitioner pronounced Talaq to the de facto complainant. But that shall not be taken as a ground for granting anticipatory bail to the petitioner. No reasons are spelled in the said talaq pronounced by the petitioner and hence, it cannot be said that there are any valid grounds for him to divorce the de facto complainant.

Hence, in the above circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner/accused No.1 is at liberty to seek for regular bail. The

lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work. 5.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
