M. Sarveshwar Reddy v. The Government Of Andhra Pradesh
THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.41497 of 2015 O R D E R: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition arises out of the order dated 03.09.2015 passed by the Andhra Pradesh Administrative Tribunal in C.A.No.1720 of 2014 in O.A.No.4348 of 2014.
C.A.No.1720 of 2014 was filed under Section 17 of the Administrative Tribunals Act, 1985 read with Sections 10 to 12 of the Contempt of Courts Act, 1971 praying that the Tribunal should punish the named respondent therein for disobeying the interim order dated 18.07.2014 passed by the Tribunal in O.A.No.4348 of 2014.
By order dated 03.09.2015, the Tribunal held that the respondent had complied with the order and accordingly closed the contempt application. As there was no adjudication by the Tribunal independently and all that was before the Tribunal was the question as to whether the named respondent in C.A.No.1720 of 2014 had complied with the interim order dated 18.07.2014 passed in O.A.No.4348 of 2014, this writ petition is not maintainable.
The Writ Petition is accordingly dismissed on this short ground. This order shall not however preclude the petitioner from availing appropriate remedies as advised in accordance with law.
Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
