This writ petition is filed challenging the impugned order in Memo No.CGM(HRD)/GM(S)/AS(DC)/PO-E/F.No.1147-E/12-35, dated 01-07-2017, wherein the petitioner was dismissed from service.

Sri Zakheer Ali Dhanish, learned Standing Counsel submits that appeal lies against the impugned order and says that without availing alternative remedy, the petitioner approached this Court straightaway. Said assertion is not disputed by learned counsel for the petitioner.

Since the petitioner has effective alternative remedy, this Court is not inclined to entertain the writ petition and it is open for the petitioner to avail alternative remedy of appeal. Accordingly, this writ petition is disposed of. Further the respondents are directed to pay subsistence allowance to the petitioner, if not already paid, in accordance with rules within a period of six weeks from the date of receipt of a copy of this order.
