HCJ & Dr.SA,J WP No.3337 of 2019 ORDER: (Per Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) Mr. Chapidi Ravi Kumar, the petitioner, has filed this habeas corpus writ petition on the ground that his wife, Akanksha Srivastava, has been taken by her family members to Allahabad in Uttar Pradesh and is being illegally detained there. By order dated 20.03.2019, this Court has directed the respondents to produce the detenue. Consequently, today i.e, 16.07.2019, Ms. Akanksha Srivastava, is present before the Court. This Court has spoken to Ms.Akanksha Srivastava. She informs this Court that she is twenty two years old. According to her, on 16.06.2018, her marriage was performed with the petitioner. It was a love marriage. However, after the marriage, she has been physically and mentally tortured by the petitioner.

She has tried to bring his cruelties to the notice of the police in Secunderabad, but the police refused to register any case against the petitioner. She further claims that due to the physical assault, she had suffered certain injuries on her head, for which, she was hospitalized at Yashoda Hospital. Therefore, she has no desire to go back to the petitioner. Instead, she would prefer to stay with her parents in Allahabad, Uttar Pradesh. According to her, her parents and her brothers have accompanied her to Hyderabad. Considering the submissions made by Ms.Akanksha Srivastava, a major person, this Court directs the police to restore her custody to her parents, who have accompanied her to the Court.

HCJ & Dr.SA,J WP No.3337 of 2019 For the reasons stated above, this Court does not find any merit in the present writ petition and the same is hereby dismissed. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
