THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3315 of 2019 ORDER:

This writ petition is filed seeking following relief :- " ....... to issue a Writ, Order or Direction, more particularly a Writ of Mandamus declaring the action of the respondents in not providing dependent employment to the petitioner in view of the death of his father who died in the accident while working as General Mazdoor in P.K.

0C-IV, Singareni Collieries Company Limited, Manuguru Area inspite of submitting the application within time, even though the petitioner is the only eligible son among the legal heirs of the deceased employee, as illegal, arbitrary, abuse of process of law, violation of principles of natural justice, contrary to rules and the circulars issued by the Company from time to time and consequently direct the respondents to consider the case of the petitioner for providing dependent employment in any suitable post as per his eligibility in view of the death of his father in the accident who died while working as General Mazdoor in the respondent company by considering the representation....." Heard Mr.S.Surender Reddy, learned counsel for petitioner and Mr.J.Srinivas Rao, learned Standing Counsel for respondents.

It has been contended by the petitioner that his father was appointed as General Mazdoor with the respondents and while discharging duties he expired in a road accident on 13.05.2017. The grievance of petitioner is that he has submitted representation to the respondents on 09.07.2018 to consider his case for appointment on compassionate grounds in any suitable post. But, so far, the respondents have not considered the case of the petitioner nor passed any orders on the representation submitted by the petitioner.

Learned counsel for petitioner submits that appropriate orders be passed directing the respondents to consider the case of the

petitioner for appointment on compassionate grounds by duly taking into consideration the representation submitted by the petitioner on 09.07.2018.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered in accordance with law and appropriate orders would be passed. This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the case of the petitioner for appointment on compassionate grounds by duly taking into consideration the representation submitted by the petitioner on 09.07.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
