THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.2821 and 2856 of 2018 COMMON ORDER:

These two Writ Petitions are being disposed of by this common order as they relate to the challenge made to the notice issued by the second respondent in a pending revision proceedings.

The petitioner claims that he is the owner of agricultural land in various survey numbers admeasuring Acs.21.16 guntas and Acs.13.31 guntas respectively. While so, his possession was threatened by the unofficial respondents herein, who are stated to be sympathizers of extremists elements. They also obtained pattadar pass books and title deeds and seeking cancellation of those documents, the petitioner filed proceedings before the third respondent, who cancelled the said documents by his orders dated 14.08.2014 and 13.08.2014 respectively. Now it appears that against the said orders, revisions were filed before the second respondent and when notices were issued for appearance of the petitioner, the present Writ Petitions are filed challenging the maintainability of the revisions at the instance of the unofficial respondents, who are stated to be not having any title to the land.

At this stage this Court is not inclined to entertain the said issue as admittedly the unofficial respondents are parties to the proceedings before the third respondent and when they

are aggrieved with the order passed by the third respondent, they can prefer a revision to the competent authority - the second respondent. But, since the point is raised by the petitioner with regard to the right of the unofficial respondents to maintain a revision, it is open to the petitioner to raise all the contentions including maintainability before the second respondent and the second respondent shall pass appropriate orders in accordance with law uninfluenced by the observations made in the present order by giving due opportunity to both the parties.

Subject to the above observations, the Writ Petitions are dismissed. The miscellaneous petitions pending in these Writ Petitions, if any, shall stand closed. There shall be no order as to costs.
