Heard the learned counsel appearing for the petitioner and the learned standing counsel for the respondents.
2. The respondents filed counter stating that the order passed by this court has been complied with. It is admitted by the learned counsel appearing for the petitioner that the retirement benefits have been paid, but his request for commutation of 40% pension has not been considered by the respondents. Therefore, he submitted a representation to the respondents to permit him to commute 40% of his pension and the same is pending with the respondents.
3. The respondents are directed to consider the representation dated 02.09.2015 submitted by the petitioner. However, the issue regarding 40% commutation cannot be adjudicated in this contempt case. Therefore, the contempt case is closed. No order as to costs. Miscellaneous petitions, pending if any in this case, shall stand closed. _________________ R.
