THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Writ Petition No.2827 of 2018 ORDER :

Heard the learned counsel for the petitioner and the learned Govt. Pleader for Municipal Administration for respondents 1 and 2 while recording offer to appear by Sri N.Praveen Kumar learned Standing Counsel for 3rd respondent from the oral instructions and perused the writ petition prayer, supporting affidavit and other material on record.

The prayer in the Writ Petition as follows:- " to issue order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the respondent No.2 in not passing any orders in an appeal filed by the petitioner dated 20.05.2017 against the orders passed by the respondent No.3 through notice No.G1/ 363/ 2017, dt.27.04.2017 refusing to regularize the plot of land of the petitioner admeasuring 5564.24sq. mts., in sy.No.501/ P and 502/ Aa/ P, situated at Ashok Nagar, Pallaburj Village, Narayanpet Village and Mandal, Mahaboobnagar District, is nothing but arbitrary, illegal, null and void and violative of principles of natural justice and also violative of Articles 14,19, 21 and 300-A of constitution of India. Consequently, direct the respondent No.

2 to pass appropriate orders in the appeal filed by the petitioner dated 20.05.2017 thereby consider the request of the petitioner for regularization of his plot of land admeasuring 5564.24sq.mts., in sy.no.501/ P and 502/ Aa/ P, situated at Ashok Nagar, Pallaburj Village, Narayanpet Village and Mandal, Mahaboobnagar District under layout regularization scheme and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice." It is the submission of the learned counsel for the petitioner that against the rejection of regularization, the claim appeal filed by him is pending with the 2nd respondent for the past seven months.

In this regard, the 2nd respondent is directed if at all disposed of the same, to communicate, if not, to dispose of on own merits within one month from the date of receipt of the order and communicate.
