Petitioners claim that their vendor Kapidi Sripal Reddy, purchased lands in Sy.No.215/2 and 219/A3 from the pattedars and thereon house plots ranging from 100 to 350 Square yards were made. Petitioners purchased house plots from Kapidi Sripal Reddy and now contends that the lands which were validly purchased by their vendor from the pattedars and which is a private land is now sought to be allotted for construction of building by the Excise Department. Alleging that such construction is not valid, a representation was made on 12.06.2017 and alleging inaction on the said representation and threatening to dispossess the petitioners, this writ petition is filed. 3.

A bare perusal of the representation dated 12.06.2017 would disclose that the lands which petitioners claim are in Sy.Nos.215/2 and 219/A3 of the concerned village. Whereas, the entries in Adangal dated 19.06.2017 enclosed as material paper Ex.P.4 would disclose that an extent of Ac.0-21 guntas in Sy.No.219/C is described as Government land and is excess land under Land Ceiling Act.

Learned counsel for the petitioners do not dispute the fact that this piece of land belongs to Government. As noted above, the survey numbers, in which petitioners claim to have purchased the house plots are different from the survey number in which Government has land. Petitioners cannot object the Government allotting the land which is classified as Government land in the

- 3 - revenue records, for the purpose of construction of Government building. There is no other material brought on record to show that the lands which are occupied by them in Sy.Nos.215/2 and 219/A3 are sought to be taken over and allotted for construction of Government building for excise department. Thus, the claim of the petitioners that the Government is encroaching into their land is not based on material on record and is contrary to their own averments in the representation made. Therefore, the declaration sought by the petitioners in this writ petition cannot be granted and the writ petition is liable to be dismissed. 5.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
