This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri T S ANIRUDH REDDY, Advocate for the Petitioner and the Additional Pubiic Prosecutor on behalf of the Respondent No-1 and of None appeared for the Respondent No.2 The Court made the following: ORDER

THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.1253 OF 2023 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short'Cr.P.C.) by the petitionerAccused No.2 to quash the proceedings against her in respect of FIR No.601 of 2022 on the file of Station House Officer, Begumpet Police Station, Hyderabad, filed for the offences punishable under Sections 420, 468 and 4fI of Indian Penal Code (for short "lPC'). 2.

Heard learned counsel for the petitioner - accused and learned Additional Public Prosecutor for the respondent - State. Perused the material on record.

The case of the 2nd respondent - de facto complainant is that they have received information from the U.S. Consulate, Begumpet, Hyderabad, stating that this petitioner has appeared for visa interview by submitting certain relevant certificates and the said certificates were alleged to be fake. During preliminary investigation, it was found that accused No.1 had fabricated the said documents and provided the same to this petitioner.

Since the alleged fabrication of documents was done by accused No.1, this petitioner would be liable for the offence under Section 471 of IPC. Prima facie, it is punishable up to two years 5.

Since the petitioner is a woman and student trying to pursue her studies and as all the documents are in possession of the police, this Court deems it appropriate to direct the investigating officer in respect of FIR No.601 of 2022 on the file of Station House Officer, Begumpet Police Station, Hyderabad, to conclude investigation without taking any coercive steps against the petitioner - Accused No.2. Further, the petitioner shall appear before the police and furnish a personal bond for an amount of Rs.50,000/- (Rupees Fifty Thousand only) and shall co-operate with the Investigating Officer as and when required for the purpose of investigation.
