- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33560 OF 2017 ORDER :
Heard.
2.
Petitioner claims that she is the owner and in possession of land to an extent of 765 Square yards in R.S.No.22 of Venkojipalem, Visakhapatnam District, purchased by her in the name of her daughter Miss.Aluru Padma, by way of three registered sale deeds on 15.08.1982. While so, the petitioner is aggrieved by the board erected in her plot, displaying the same as Government land. Aggrieved by erection of the said board, petitioner submitted several representations starting from 22.05.2016 and latest being 02.03.2017, bringing to the notice of the Joint Collector that the subject property is her private property and not covered by the Urban land ceiling and board was illegally erected. Alleging inaction on the said representations, this writ petition is filed.
3.
Learned Assistant Government Pleader, on instructions, sought to contend that subject land is the urban land vested in the State and that a notification was also issued under Section 22-A
(1) (d) of the Registration Act. However, learned Assistant Government Pleader, does not dispute the fact that so far no orders are passed on the representations of the petitioner. 4.
Having regard to these submissions, without expressing any opinion on merits, the Writ Petition is disposed of, directing the Joint Collector, Maharanipeta, Visakhapatnam (3rd respondent) to examine the claim of the petitioner as ventilated in her
- 3 - representations made the latest being 02.03.2017 and pass appropriate orders, as warranted by law, by assigning due reasons in support of the decision and communicate the same to the petitioner. A decision to this effect shall be taken within a period of six (6) weeks, from the date of receipt of copy of this order. Pending consideration of the representations, the Government may not develop the land for any other purpose. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
