Ranjan Kumar Sahu v. The State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.993 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.2, in Crime No.102 of 2017 on the file of the Station House Officer, Railway Police Station, Khammam, Secunderabad District. 2.
The offences alleged are under Section 8(c) R/w.20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
Learned counsel for the petitioner submits that the petitioner, along with other accused, earlier filed Criminal Petition No.11266 of 2017 and this Court, while granting bail to the accused Nos.1 and 3, observed that the petitioner herein being a male person, does not have the benefit that accused Nos.1 and 3, who are women, one of whom was pregnant, had and dismissed the bail application of the petitioner.
5.
A perusal of the earlier order of this Court shows that this Court has gone into the merits of the case and dismissed the bail petition, insofar as the petitioner herein is concerned. Hence, when once the earlier bail petition of the petitioner herein was dismissed, on merits, this Criminal Petition cannot be entertained as there are no changed circumstances. Hence, the Criminal Petition is dismissed.
As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
