HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SMT JUSTICE T.RAJANI FAMILY COURT APPEAL No.133 of 2017 Date:04.4.2017 Between:

Bhavana Jayashree, W/o Dr. Bhavana Madhu ..... Appellant And:

Dr. Bhavana Madhu, S/o Bhavana Venkata Krishnaiah and two others.

.....Respondents Counsel for the appellant: Mr. Ch. Venkata Raman Counsel for the respondents: Mr. Maheswara Rao Kuncham The Court made the following:

CVNR, J & TR, J FCA.No.133 of 2017 Dated:04.4.2017 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The appellant, who substantially succeeded before the learned Judge, Family Court-cum-V Additional District Judge, Tirupati in FCOP.No.60 of 2012 filed by the respondents, filed this appeal rather needlessly.

Respondent No.1 being the father and respondent Nos.2 and 3 being the grand parents of the minor child-Bhavana Mahathi filed the afore-mentioned FCOP for custody of the minor child from the appellant-the mother of the minor child. The Family Court while declining the said relief, however, felt it appropriate to confer visitation rights on the respondents with regard to the minor child on every second Saturday and second Sunday in every month at Chennai at a convenient place for both parties. The appellant filed this appeal feeling aggrieved by this part of the order of the Family Court.

A perusal of the grounds of appeal reveals that nothing of substance has been raised to over turn the decision of the Family Court. In our opinion, the respondents are entitled to at least visitation rights if not custody of the minor child till she attains majority. The order of the Family Court is not only reasonable

CVNR, J & TR, J FCA.No.133 of 2017 Dated:04.4.2017 but also equitable. Hence, we do not find any reason to interfere with such order.

The Family Court Appeal is, accordingly, dismissed. ____________________________ JUSTICE C.V.NAGARJUNA REDDY ________________ JUSTICE T.RAJANI 04th April 2017 DR
