HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39240 of 2012 ORDER:

This writ petition was filed challenging the action of the official respondents in not taking steps for execution of the Non Bailable Warrant pending against the 8th respondent since 21.01.2009.

2. The 7th respondent-Sub Inspector of Police, I Town Police Station, Narsaraopeta, Guntur District, submitted a written instructions to the learned Government Pleader for Home (A.P.) stating as follows:

"It is respectfully submitted that the Advocate Commissioner of Hon'ble Judicial Magistrate of First Class Court, Elur, West Godavari District filed a requisition before this respondent police station on 21.01.2012 seeking police assistance in executing the warrant against the 8th respondent/Orsu Srinivasa Rao herein. Pursuant to the same, the respondent police deputed the staff for execution of warrant against the 8th respondent.

It is also submitted that the Advocate Commissioner enquired the wife of the 8th respondent about his whereabouts, but she did not cooperate with them, for which the Advocate Commissioner not executed the Non Bailable Warrant.

It is pertinent to submit that as of now, no warrant is pending execution with the police of Narasaraopet Town Police against the 8th respondent. If any warrant is issued afresh, the respondent police will take steps as per law."

In view of the same, it is for the petitioner to take

appropriate steps, in accordance with law, in C.C.No.105 of 2008 pending adjudication before the Court below.

4. The Writ Petition is accordingly disposed of. No order as to costs.
