HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.2794 of 2018 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

" .......to issue a writ of mandamus or any other appropriate writ or direction declaring the proceedings of the 4th respondent issued in RC.No.A4/ 344/ 2017 dated __.01.2018 signed on 29.01.2018 as illegal, arbitrary and in violation ofprinciples of natural justice and pass such..."

Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise appearing for the respondents and perused the material on record. 3.

In view of the very letter of the Inspector, Prohibition and Excise dated 11.01.2018 of the purchase is 6 Nips per each day for three days from said A4-shop of the petitioner, which is not consistent with the proceedings showing having found 16 bottles and there is a confession of purchases from the A4-shop of the petitioner, the interim suspension pending enquiry by the impugned order in Rc.No.A4/ 344/ 2017 dated 29.01.2018 passed by the Superintendent, Prohibition and Excise, Proddatur, is set aside, by directing the Superintendent to conduct enquiry and pass appropriate orders under Section 31 of the A.P.Excise Act.

Accordingly, this Writ Petition is disposed of. 5.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
