Veerla Ravindra Babu v. The State Of Andhra Pradesh
SMT JUSTICE T. RAJANI CRIMINAL PETITION No.994 of 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 and A2, in Crime No.170 of 2017 on the file of the Station House officer, Narsaraopeta I Town Police Station, Guntur District.
2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3.
A perusal of the complaint shows that the de facto complainant went to the house of the accused along with others to demand the amount payable to him and when he asked about the amount, the accused beat him with iron rods on his face and meanwhile petitioner No.2, who is the wife of A1, abused the de facto complainant in his caste name.
4.
Considering the nature of the allegations and considering the fact that the acts of A2, prima facie, are attracted by the provisions of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, Section 18 of which does not permit grant of anticipatory bail, this court opines that this is not a fit case for granting anticipatory bail to the petitioners. 5.
Accordingly, the Criminal Petition is dismissed. However, the petitioners are at liberty to file a petition seeking for regular bail before the court below and the court below shall dispose of the application, if any filed, on merits, expeditiously, as early as
possible, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
